East Brunswick, N.J. – The New Jersey Department of Labor and Workforce Development (NJDOL) will hold a public hearing on Monday to discuss proposed new rules N.J.A.C. 12:11, which would create new regulations around the “ABC Test” to determine an employee versus an independent contractor in New Jersey. The proposed new rules – which mimic action taken in California that has led to disastrous results – would drive independent contractors and the self-employed to the verge of extinction in New Jersey and severely impact the state’s port community and supply chain.

Senate Labor Committee Chair Gordon Johnson, Senate Legislative Oversight Committee Chair Andrew Zwicker and Senate Commerce Chair Joe Lagana have already sent a letter to the NJDOL expressing concern over “the substantial negative impact that these regulations may have on thousands of independent business owners who are properly classified…” A copy of the letter is attached.

Circulate NJ coalition members will be speaking out against the proposal during the public hearing, which will take place this Monday, June 23, from 10am – 12pm at the New Jersey Division of Taxation, located at 3 John Fitch Way in Trenton.
