Lower Township Man Resists Arrest and Assaults Officer

Lower Township – On June 19, 2019, at approximately 11 p.m., Patrol Officer Jonathan Scheck conducted a motor vehicle stop for speeding in the 500 block of Seashore Road, in the Erma section of the Township. During the course of the stop, Patrolman Scheck determined the operator, David C. Hughes, 52 years of age, from North Cape May, was operating his vehicle while under the influence of alcohol.
While attempting to place Mr. Hughes under arrest for Driving While Intoxicated, Mr. Hughes became loud and abusive in a threating and combative manner, refusing to allow the officers to arrest him. Mr. Hughes continued to pull away and struggle with the officers during his arrest. It was necessary for the officers to use a reasonable amount of force to control the defendant’s actions to effect the arrest. Mr. Hughes was subsequently placed into the rear of a patrol vehicle where he spit in the face of the arresting officer.
David Hughes was charged on a warrant for Resisting Arrest, 2c:29-2a (3rddeg), Aggravated Assault on a Law Enforcement Officer, 2c:12-1B(5)(A) (3rd deg), Throwing Bodily Fluids on a Law Enforcement Officer, 2C:12-13 (4th deg), Failure to Allow Fingerprinting, 53:1-15 (Disorderly Persons Offense).
In addition to the criminal charges, David Hughes was issued motor vehicle summonses for Driving While Intoxicated, Refusal to Submit Breath Samples, Reckless Driving and Speeding. David Hughes was lodged in the Cape May County Correctional Center.
