BROOKLAWN, NJ (November 7, 2018)(CNBNewsnet)--A lawsuit filed by the Borough of Brooklawn against Brooklawn Norse LLC, of New Milford, N.J. the owners of the
Brooklawn Apartments, 301, 401 and 501 Browning Road is working its way to through the court system. Asked about the status of the suit, Ryan Giles, Brooklawn Administrator, said that he is unable to comment on the legal action stating, "As it is still an open case and not resolved, I can't really discuss it. It may be resolved before years end. "
The lawsuit, dated January 19,2018, alleges that the apartment owner on or about April 17, 2017 failed to obtain construction permits and to request required inspections for several hot water heaters. The landlord was notified of the violation by the borough's construction code official, Christopher Mecca, by certified mail/return receipt.
From the legal papers, "The Defendant, Brooklawn Norse LLC had failed and refused to pay the lawfully assessed penalties as required by NJAC 5:23-2.31(b), and did not filed a timely appeal to any of the referenced violations. The assessed penalties as of January 19,2018, total approximately $234,000."
"This action is brought pursuant to the Penalty Enforcement Act, NJSA 2A:58-1,et seq, with the Plaintiff, the Borough of Brooklawn, being entitled to payment in the amount of $234,000 increasing at a rate of $6,000 per week, together with interest, costs of suit, attorney's fees and any other remedy provided under NJSA 2A:58-1 et seq."
