 press release

Ibntroy A. Gaines  (DOB 4/30/93), of Sicklerville NJ  has pleaded guilty to possession of a weapon by someone prohibited from legally owning one in connection with an 11/28/15 shooting incident at a Franklinville NJ roller skating rink.

Gaines entered the plea to the second-degree offense,  among the most serious of the charges he faced, on Monday (9/26) following negotiations with Assistant Gloucester County Prosecutor Steven Salvati.

AP Salvati will recommend that Gaines be sentenced to five years in New Jersey state prison with no eligibility for parole for the entire prison term.

Superior Court Judge Robert P. Becker accepted the plea and scheduled sentencing for 12/16. Gaines remains jailed in default of $500,000 bail.

Gaines became subject to the so-called “certain persons not to have a gun”  statute as a result of his 2013 guilty plea to burglary and  escape in Atlantic County, for which he served a year in county jail.

In the 2015 incident at the Franklin Skating Center,  a  Franklin Township police officer posted near the Franklin Skating Center saw a shot fired outside the rink by a male later identified as the defendant.  The male fled following the shooting,  which did not strike anyone in a crowd that had gathered during the performance of a skit at the rink.  The shooter was reported to have had a confrontation with te skit performer.

Gaines was apprehended by US Marshals at a New Orleans motel on 12/4/15.

In the plea agreement, additional charges of assault and weapons possession  against Gaines are to be dismissed at sentencing.
