Prosser Receives Seven Year Prison Sentence for Baseball Bat Assault

WOODBURY NJ--Brandon M. Prosser  (DOB 1/15/92), of 522 Wesley Ave., National Park pleaded guilty today  (10/29) to second-degree aggravated assault, acknowledging that he used an aluminum baseball bat to strike the head  of a 52-year-old man sleeping on a sofa in the defendant’s home on 6/18/09.


At the time, Prosser was a juvenile and a Family Court judge ordered that he be prosecuted as an adult. The victim, who had a relationship with Prosser’s mother, sustained multiple skull fractures.


“Did you do that recklessly, manifesting extreme indifference to human life?”  defense attorney Ron Appleby asked Prosser,  his client.  Prosser said yes.


Assistant Gloucester County Prosecutor Temperance Williamson asked Prosser whether the single blow placed the victim in a life-theatening condition, He acknowledged it did.


In a negotiated plea, Williamson will recommend that Prosser be sentenced to seven years in New Jersey state prison. He must serve 85 percent of the prison term before becoming eligible for parole. Superior Court judge Kevin T. Smith scheduled sentencing for Jan. 17, 2014, two days after Prosser’s 22nd birthday.
