Marijuana convictions could bring extended term

WOODBURY NJ--As a result of a prior narcotics conviction, Marquis C. Moody (DOB 6/24/84), of 476 Deptford Ave., Deptford NJ faces an extended prison term following his conviction today (10/30) on charges of third-degree possession of marijuana with intent to distribute and fourth-degree possession of more than 50 grams of marijuana.
At sentencing scheduled for 12/20/13, Senior Assistant Gloucester County Prosecutor Paul Colangelo will request that Moody be sentenced as a second-degree offender, which could result in a state prison sentence of five to ten years.
A jury that found Moody guilty heard testimony last week about an 11/25/11 Deptford motor vehicle stop in which Moody was a passenger and was initially arrested on active warrants. A search located about two ounces of marijuana behind Moody’s front passenger seat, along with 43 empty plastic baggies and a digital scale. Deptford Officer Rudy Ruiz testified that Moody acknowledged the marijuana was his.
The driver, Sheldon W. Werry (DOB 12/3/92), of West Deptford, also was charged with narcotics offenses and was admitted to the Superior Court’s Pre-trial Intervention Program.
