Stuart was a Deptford Township police officer who was off-duty at the time of the shooting.  He has since been suspended.

The  four-count indictment charges Stuart with two counts of first-degree murder, the first alleging that he “did cause the death of David Compton,” and the second alleging that he “knowingly did cause the death of David Compton or knowingly did inflict serious bodily injury upon David Compton which resulted in the said David Compton’s death.” The grand jury also voted to charge Stuart with first-degree aggravated manslaughter and second-degree possession of a weapon for an unlawful purpose.
