Westville NJ man pleads to assaulting ER doctor


Michael B. Biernacki  (DOB 9/13/82), of 120 Florence Ave., Westville NJ pleaded guilty today  (1/9) to assaulting Underwood-Memorial Hospital emergency room physician Dr. Thomas Love in the Woodbury NJ hospital’s ER as the doctor attempted to intervene in a confrontation between nurses and the defendant  on July 4, 2010.


Dr. Love suffered multiple fractures of his nose from the assault.


In pleading guilty to third-degree aggravated assault, Biernacki agreed to an 18-month New Jersey state prison term, to be recommended by the Gloucester County Prosecutor’s Office at his March 5 sentencing.


Appearing before Superior Court Judge M. Christine Allen-Jackson, Biernacki acknowledged that he caused bodily injury to Dr. Love as the doctor was performing his duties in the emergency room.  Biernacki, his brother and a Woodbury man had come to the ER claiming Michael Biernacki had been injured by a motor vehicle.
