Dear Paul J. Kain,

The New Jersey Government Records Council (“GRC”) sent you a request for the Statement of Information via cover letter dated April 8, 2009 in order for you to present the facts and legal arguments from your perspective in response to the denial of access complaint filed against you in the above referenced complaint. The GRC is not yet in receipt of the Statement of Information.

The Open Public Records Act specifically states that the public agency bears the burden of proving that the denial of access is authorized by law. N.J.S.A. 47:1A-6.

Please be advised that if the GRC is not in receipt of the Statement of Information no later than three (3) business days from receipt of this letter, this complaint will proceed to adjudication based only on the information submitted in the Denial of Access Complaint by the requestor of the records.

The GRC appreciates your immediate attention to this matter. If you have any questions,please contact the Case Manager assigned to this complaint.
